The Supreme Court on Thursday affirmed People’s Democratic Party’s Darius Ishaku as duly elected Governor of Taraba State.
In dismissing the appeal filed by the All Progressive Congress (APC)candidate, Aisha Al-Hassan, the apex court held that the appeal lacked merit.
In a unanimous decision, the seven-man bench of the Supreme Court led by Justice Ibrahim Galadima after taking the arguments from both contesting sides dismissed the appeal.
Justice Bode Rhodes-Vivour who delivered the unanimous judgment this afternoon, said:
“I am of the firm view that there is no merit in this appeal and it is hereby dismissed.
The Judgment of the Court of Appeal is affirmed and the election of Governor Darius Ishaku is hereby upheld.”
The Supreme Court says it will give reasons for the judgment on February 22, 2016.
Recall that the Court of Appeal in Abuja in December, 2015 ruled that Ishaku’s nomination by PDP could not be questioned by a non-member of the party and thus stating that his nomination complied with section 85 of the electoral act. This was after the appellant scored an earlier victory at the election tribunal.
Aisha Alhassan had asked for the cancellation of Darius election arguing that the governor was not properly nominated by his party.
